Terms and Conditions

Assiniboine Tipis provide merchandise to you (buyer) subject to the following Terms and Conditions, which may be updated by us from time to time without notice to you. This web site is owned and operated by Assiniboine Tipis. Use of the content, services, and/or products presented in any and all areas of this site constitutes the user's agreement to abide by the following terms and conditions and those posted in specific areas of the site.

1. Purchase Agreement
A purchase is a contract between you - the buyer, and us - Assiniboine Tipis. With the exception of custom orders, orders will be fulfilled in a first come, first served basis, and will be based upon availability. When placing an order, you declare that you have read and understood our terms and conditions listed below, and related to Assiniboine Tipis services and merchandises. You declare that you acknowledge and agree with these terms and conditions.

2. To Place an Order
You declare that you are older than 18 years old or legally allowed to make purchases on the Internet, and use the provided credit card to place an order, to make its purchase, or that you have received the agreement allowing you to use Internet, to place an order and to make its purchase on our web sites. After placing an order, you will receive a confirmation by e-mail or mail. An order will only be processed once its full payment has been received.
Without payment received within 15 days after placing an order, the order will be reviewed and/or canceled.


3. Availability, Prices, Payment and Delivery
Should items not be available, you will be informed by e-mail as soon as possible. If items are no longer available or discontinued, your payment will not be processed. Prices are indicated in Canadian funds, taxes are not included, neither are shipping and handling costs. In the event that you order items which you cannot legally possess in your area, Assiniboine Tipis will hold you responsible for all legal fees, penalties, loss of business, etc. it may incur resulting from litigation into which it is drawn due to your lack of knowledge of local laws. We will assume commercial orders have obtained licenses and understand the terms of their countries, province and state's, regulations.

A full up-front payment is required for all custom orders such as tipis, liners, poles, custom artwork on a tipis and/or liners, clothing, fur items, Native arts and crafts, archery items, artifacts, etc. If a deposit for a specific order is required and agreed upon by the customer, this deposit will be non-refundable. All custom order payments are not refundable.

Credit Card payments will be processed by Assiniboine Tipis in Canadian funds. As of January 2021, a 2.13% processing fee will be added to all credit card payments.
Assiniboine Tipis account information for a payment by wire will be transmitted by e-mail to our customer at our discretion. Assiniboine Tipis is not responsible for banking fees or other related to national or international payments. Canada Post Money orders shall be written to the name of Assiniboine Tipis and send to our address in Canada: Assiniboine Tipis PO Box 649 Lundar, Manitoba R0C1Y0 Canada.

Payments due on open invoices must be made in time when requested by Assiniboine Tipis. Unpaid orders will be canceled without any form of compensation. All goods including shipping costs and taxes must be fully paid prior to goods being shipped.
A 3% interest charges will be applied to all merchandise orders other than tipis, tents, liners, poles and artwork accounts past due after 30 days.
Storage fees will be applied to goods not picked up past 30 days of date of delivery.
Storage Fees: $ 40.00 per item and per month, payable on a monthly basis.
Storage Fees for Poles: $ 65.00 per month, payable on a monthly basis.
Goods not picked up or fully paid for after 90 days will become the property of Assiniboine Tipis.

Failure to Pay an Invoice:
Due invoices will be forwarded to the appropriate collection agencies; Key Collection (Canada), Rapid Recovery Solution (USA) and CLW (Europe).


4. Shipping and/or Freight Costs
Assiniboine Tipis does not sell shipping and/or freight services. Shipping and freight arrangements are provided by Assiniboine Tipis as a complimentary service, at cost price, to our customers.
Our shipping and freight costs are obtained either via the online web sites of the companies listed below or through agents. As such, those shipping/freight rates are non-binding as they may change often, sometimes daily. They will be reviewed when the actual shipping in made.
Assiniboine Tipis will not be held responsible for any rate changes i.e. surcharges, extra fees, extra taxes, fuel surcharges, storage fees, delays, etc.
All additional fees applied by our freight/shipping companies/brokers will be charged on your account/invoice/credit card.
Shipping and freight services are supplied by Loomis, UPS, Canada Post, Manitoulin Transport, and Gardewine Transportation Services.
Air cargo services are provided by local airlines.

Note
Our online system can not calculate shipping costs for large items such as tipis, liners, poles and tent frames. After placing an order, we shall verify those shipping costs. An order placed online will only be registered once these costs are known and accepted by you, the customer.

Shipping of Poles
Due to their sizes, poles are shipped by trucks. It is your responsibility to assist in unloading the poles when they arrive at destination. Please note that there is a 15 mins maximum limit allowed for waiting time once at destination. After waiting for 15 mn, the poles will be returned for storage to its local terminal.
There will be no other delivery attempt
You will have to pick up the poles yourself at the freight terminal at your own expenses. Storage of poles at the freight terminal for more than 1 business day will be subject to storage fees payable by you.

Sorry, we do not longer accept out of province cheques There is a 3 weeks hold when a payment is made by cheque.

The Canadian General Sales Tax (GST or HST where applicable) will be charged to our customers in Canada. Retail Sales Tax (RST 8%) will be charge to our customers in Manitoba.

6. Tax exemption and/or Indian Status Card
First Nation Organizations and members of First Nations living on a reserve must provide either a Certificate of Tax Exemption or a copy their Indian Status Card to obtain their tax exemption.


7. Prices
Prices are subject to change without notice. Shipping cost may change according to freight forwarders price changes (i.e. Fuel surcharge may increase). Our customers will be advised of those changes before the merchandise is shipped out. Merchandise remains our property until fully paid. No merchandise shall be shipped unless fully paid.

8. Botanical - Warning
Any information about botanical on our web site is provided for historical background and educational purposes only. Many of these plants are said to have beneficial medicinal properties when used in certain ways. However, some of these plants might be harmful if used inappropriately. We provide these plants as a service to those of you who have a legitimate need for them, and strongly urge you to seek the assistance of knowledgeable people before using some of these plants. Always use common sense and be responsible when using botanical. We cannot be responsible for any ill effect caused by using these plants.

9. Return Policies and Procedures
Our goal is your satisfaction, if for some reason you shall not be satisfied with your purchase, you can return it within 15 days in unused condition, for a refund of your purchase price minus shipping costs, 15% administration and restocking fees.
Before returning any merchandise, you must first obtain our authorization. Returned merchandise must be sent back to our gallery in Lundar unused and in its original packaging. Merchandise returned without our consent will not be refunded. In addition, you will be billed for all other costs related to the return of the merchandise.
All returns must be fully insured against loss and damage, the buyer being responsible for lost and damaged merchandise. Merchandise which has been damaged or showing any signs of use will not be refunded.
Shipping within Canada must be done via Express Mail unless otherwise agreed upon between Assiniboine Tipis and the buyer. All merchandise must be returned in its original packaging. Shipping and insurance costs are to be paid by the buyer.
International shipping must be done via International Express Mail unless otherwise agreed upon between Assiniboine Tipis and the buyer. All merchandise must be returned in its original packaging, and libeled as "Return To Sender". The buyer pays all return costs including shipping, broker and Customs fees, Insurance, etc.

Final Sale Items
Sales of following items are final, deposits and payments made for the purchase of these items are non refundable: CDs, DVDs, foods, all custom orders, artifacts (i.e weapons, headdresses, fans, etc.) regalias (i.e. moccasins, leggings, etc.), antiques, hides, furs and wildlife parts, musical instruments, tipis & wall tents, liners, poles and steel frames, custom artwork on tipis and liners.

10. Order Cancellation Policies
a. General Merchandise

All orders are automatically processed on our secure merchant processor and sent for shipment as soon as they are placed. During this process we incur irreversible fees. Therefore, while we understand that orders might need to be changed sometimes, we are unable to do it free of charge after a certain point. We strictly adhere to the following cancellation policy:
• If you cancel your order BEFORE it has been shipped, you will be assessed a 15% cancellation fee.
• If you cancel your order AFTER it has been shipped, please follow our Return Policies and Procedures listed above.
• Orders which are REFUSED AT DELIVERY and returned without our authorization will not be refunded, and assessed all the applicable costs listed above.

b. Tipis, Tents, Liners, Poles and Painted Decorations
Full payments of tipis, liners, tents, poles and decorations are required by the due date as indicated on your invoice, which constitute the final deadline. Orders not fully paid by this deadline will be perceived as abandoned by the customer and will therefore be canceled by Assiniboine Tipis without any form of compensation and/or refund, and all deposits paid will be lost in full by the buyer.

• The buyer (you) agrees to waive all claims against Assiniboine Tipis for all charges related to an order cancellation, authorized return, unauthorized return or refused merchandise.

11. Defect Merchandise, Visible Damages Occurring During Transportation
If you would received a damaged parcel (box crushed or destroyed), customer must refuse to take possession of the box while at delivery time and sign declaration provided by Post Office or Delivery Man. Our product are always send with an insurance. Assiniboine Tipis will take care of all the process to obtain a refund from the Post Office or Freight Forwarder. We will either replace the merchandise or refund the total invoice (merchandise + shipping Cost – but not customs fees). Please note that inquiries can take up to 90 days. Non Visible Damages occurring during transportation
Please fill and sign a declaration then fax this document to our office in Lundar (1 204 762 6133) within 24 hours after receiving the parcel. Add a copy of your invoice, a picture of the damaged item and specify what is the damage.
Refund or Exchange on a damaged merchandise.
Our merchandises, tents and tipis are carefully inspected before shipping, and our products are free of defects in material and workmanship. Nonetheless, in such a case, we would do everything possible to fix the problem and satisfy our customers. We will repair or replace the product at our discretion when returned to us, freight prepaid. Any returns for repair or replacement will require prior authorization. Please fill and sign a declaration then fax it to our office in Lundar (1 204 762 6133), add a copy of your invoice, and explain and send a picture of the problem.
Assiniboine Tipis shall not be liable for damages resulting from the use or other outside forces beyond our control.
Assiniboine Tipis will not be responsible for damages, tears, and tear of seams due to setting ups and downs of tents and tipis. Assiniboine Tipis will not be responsible for the way you are taking care of your tent or tipi (please refer to set up instruction and care of canvas tents provided to you by mail). Such misuse of the tents and tipis do not entitle customer to a refund or replacement, being of your sole responsibility.

12. Indemnity/Limitation of Liability
Under no circumstances, including, but not limited to, negligence, shall Assiniboine Tipis, or its affiliates be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use, Assiniboine Tipis materials and Web Sites.

13. Agreement
You declare that you have read and understand the terms and conditions above listed and related to Assiniboine Tipis services and materials. You declare that you acknowledge and agree with these terms and conditions.
